Terms & Conditions
1. About deteqta
deteqta is an AI-powered pricing and profit estimation tool for UK vintage clothing and footwear resellers. deteqta is operated as a sole trader business based in England.
By creating an account and using deteqta, you agree to these Terms and Conditions. Please read them carefully before using the service.
For questions, contact us at support@deteqta.com.
2. Pricing recommendations
deteqta provides price recommendations based on AI analysis of recent resale market data. These recommendations are estimates only and do not constitute financial, commercial, or investment advice.
Resale markets fluctuate and prices achieved may differ materially from our recommendations. deteqta accepts no liability for buying or selling decisions made on the basis of our estimates.
It is your responsibility to conduct your own research before making any purchasing or selling decision. deteqta is a decision-support tool, not a guarantee of profit.
3. Authenticity
deteqta is a pricing and profit estimation service. It is not an authentication service and does not verify whether any item is genuine.
All price recommendations are made on the assumption that the item presented is authentic. If you purchase a counterfeit item in reliance on a deteqta report, deteqta bears no responsibility for any resulting loss.
The fake detection feature (available in a future release) flags potential concerns for further investigation only. It does not constitute authentication and must not be relied upon as confirmation that an item is genuine or counterfeit. Results will be expressed as concerns to investigate, never as a definitive determination of authenticity or inauthenticity.
4. Limitation of liability
To the maximum extent permitted by applicable law, deteqta and its operators shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage arising from:
– Reliance on pricing recommendations or any other content provided by deteqta
– The purchase or sale of counterfeit, misrepresented, or stolen items
– Any failure, interruption, inaccuracy, or error in the service
– Loss of profit, revenue, anticipated savings, or data
– Any third-party platforms or markets on which you list or sell items
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraudulent misrepresentation, or for any liability that cannot be excluded under applicable law.
Our total aggregate liability to you in connection with these terms shall not exceed the total amount paid by you for the deteqta subscription in the 12 months preceding the event giving rise to the claim.
5. Subscription and billing
deteqta offers three tiers: Free (3 lifetime scans), Standard (£4.99/month or £39.99/year, 75 scans per calendar month), and Pro (£12.99/month or £99.99/year, unlimited scanning subject to a fair-use soft cap of approximately 500 scans per month). All prices include VAT where applicable.
Subscriptions are billed in advance and renew automatically at the end of each billing period. You can cancel at any time via the billing portal accessible in Account settings. Cancellation takes effect at the end of the current billing period; you retain full access until then.
We do not offer partial refunds for unused periods of a subscription, except where required by applicable UK consumer law.
Cooling-off right: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you ordinarily have a 14-day right to cancel a subscription and receive a full refund. However, when you subscribe to deteqta, you are asked to confirm that you want immediate access to the service. By ticking the confirmation checkbox at checkout, you acknowledge that once the service has begun, your 14-day right to cancel is waived in respect of the service already performed. This does not affect your right to cancel future billing periods.
We reserve the right to change pricing with 30 days' notice to existing subscribers. Continued use after the notice period constitutes acceptance of the new pricing.
6. Acceptable use
You must not use deteqta for any unlawful purpose or in any way that violates these terms. In particular, you must not:
– Use deteqta to facilitate the sale of counterfeit, stolen, or prohibited goods
– Attempt to circumvent scan limits by creating multiple accounts
– Scrape, copy, or redistribute any part of the deteqta service or its output commercially without our written consent
– Attempt to reverse-engineer, decompile, or tamper with deteqta's systems
We reserve the right to suspend or terminate accounts that breach these terms without notice or refund.
7. Intellectual property
The deteqta brand, app, and all content we produce are owned by the operator of deteqta. You may not reproduce, distribute, or create derivative works from any part of the deteqta service without our written consent.
The content of individual Valuations generated for you (including pricing recommendations and analysis) is provided for your personal use as a reseller. You may share individual reports, but may not use report data commercially or in aggregate without our consent.
8. Privacy and data
Your use of deteqta is also governed by our Privacy Policy, which is incorporated into these terms by reference. The Privacy Policy explains what data we collect, how we use it, and your rights under UK GDPR.
You can access the Privacy Policy at any time via Account → Privacy.
9. Service availability
We aim to provide deteqta continuously, but we do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect the service. We will provide reasonable notice of planned downtime where possible.
We reserve the right to modify, suspend, or discontinue any feature of deteqta at any time. We will provide reasonable notice of significant changes that affect your use of the service.
10. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via the app or by email at least 14 days before they take effect. Continued use of deteqta after the notice period constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these terms affects your rights as a consumer under applicable UK consumer protection legislation, including the Consumer Rights Act 2015.
